42 Reasons to Legalize Marijuana

Marijuana is the most commonly used illicit drug and has been for several years. While many use it for personal pleasure, there are also many who use it for medical purposes. Interestingly enough, while the rate of marijuana use has consistently gone up, a national survey also shows a reduced rate of prescription drug use among young adults. According to a new report by the Substance Abuse and Mental Health Services Administration (SAMHSA) states that the rate of past month’s nonmedical use of prescription drugs among young adults (18-25 years old) in 2012 was 5.3%. This is much lower than 2009’s rate, which was 6.4%. Is there a connection between these two statistics? If so, what could it be?

Health Benefits of Marijuana

First of all, what are the ‘promoted’ health benefits of marijuana? Ancient Indian writings confirm that marijuana has been used for medicinal purposes for approximately 4000 years. While there has been no proof that marijuana is actually able to cure anything, some say that marijuana can treat symptoms of pain or nausea that are caused by multiple illnesses.

Marijuana has been known to give people relief from muscle spasms or chronic pain, increase and restore metabolism and suppression from nausea. Marijuana can help AIDS patients with the nausea, loss of appetite, vomiting from the condition itself and medications. Marijuana relieves the internal eye pressure of glaucoma, and therefore relieving the pain and slowing or even stopping the condition. Many side effects of the medication to stop cancer can be relieved with marijuana. Some studies even suggest that marijuana tends to slow down the progress of some types of cancer. In some patients, epileptic seizures can be prevented with marijuana use. Disabled-World.com says that marijuana helps to alleviate the pain caused from many types of injuries and disorders.

Marijuana vs Prescription Drugs

Now, what is the connection between marijuana and prescription drugs? While there have been no studies that have concrete evidence for a theory, there are a few possible reasons. Firstly, the legalization of marijuana took a huge step forward last year when both Colorado and Washington voted to legalize adult social use of marijuana. Prior to this, eighteen states permitted marijuana for medical purposes only. For obvious reasons, the legalization of marijuana for social use is sure to increase the rate.

Secondly, most, if not all, prescription drugs have harmful or painful side effects. Many people use marijuana to deal with these side effects. Some of the most common of these include headaches, stomachaches, joint and muscle pain and decreased control over bodily functions, as well as psychological side effects such as depression or suicidal thoughts. In addition, Quest Diagnostics says that most patients about 60% of patients failed to use their prescription drugs as indicated by their ordering physician in 2012. Prescription drug misuse continues to be a healthcare concern for a significant percentage of patients. This misuse of prescription drugs only intensifies any harmful side effects and can create a serious problem.

Still Much to Learn

For now, the statistics show how the changing levels of usage between different types of drugs. However, the medical field is one in which life-changing discoveries are being made at an exponential pace. New and improved prescription drugs are constantly being made. Perhaps soon there will be some that have no side effects at all. Perhaps doctors will find a way to use marijuana in ways that we haven’t even dreamed. Only time and our scientists will tell.

NY Legalizes Medical Marijuana

In the great state of Colorado, there have been some major changes in the judicial department regarding the distribution and use of marijuana. It is now one of the fourteen states that has legalized the use and distribution of marijuana for medical reasons. Marijuana laws are still a hotly debated topic here because there are people on both sides of the argument who feel very passionately about their opinions.

The Obama administration has put marijuana usage and distribution as a low priority for the D.E.A. This has led to a swell in the medical marijuana industry and now dispensaries are almost as common as liquor stores here in Colorado. But in order to see how it affects you, learning about these new laws is an absolute necessity. If you are planning to use or you are curious about what these new laws will bring to Colorado, then here are the basics laid out for you.

An important distinction that must be noted is that only those with a medical marijuana card can purchase it. In order to obtain one of these cards, the patient must have a serious illness like HIV, glaucoma, cancer, or any other illness that includes chronic and severe pain. Of course, the use of marijuana without a medical card is still an offense. But Colorado law has always been lenient on the use of the drug. Possession without a prescription, as long as it is under 1 ounce is only a petty crime. This means no jail time and a small fine much like a speeding ticket.

The possession of the drug in larger quantities, however, is still considered a misdemeanor and illegally distributing the drug still results in a felony charge of up to four years in prison. The seriousness of not following the proper channels cannot be stressed enough. If you do plan on using marijuana for recreational or medical use, be sure to take every precaution. If you have been caught using or distributing, then hiring a criminal attorney familiar with marijuana law is recommended.

Whether you are trying to find ways to use marijuana or if you are just curious as to all the changes that have been going on in Colorado, the above statements should clear things up a bit. It is still an extremely controlled substance and you can still get in a lot of trouble for having it in large quantities.

Meet the 14-Year-Old Who Helped Legalize Medical Marijuana In NY [Documentary] | Elite Daily

1. Decriminalizing and regulating marijuana will reduce minors’ exposure to the drug and other, harder narcotics. For years teenagers have found it easier to get their hands on marijuana, than it is for them to get a bottle of alcohol. And that is simply because alcohol is regulated, readily available and as a result, not profitable for your local drug dealer to sell. Marijuana however, is profitable and is a great Segway for the dealer into pushing the, likely impressionable, teen into something harder, addictive and very profitable for him.

Another point, while we’re on the topic of regulation, is that the dealer in this scenario could be selling something dangerous like synthetic marijuana, or even marijuana laced with something and the buyer, potentially someone in need of relief from an ailment, could be none-the-wiser and be doing a great deal of damage to their health.

2. Billions of dollars in profit from marijuana help to fuel drug syndicates and vanish from the US economy. This money could be used to generate a huge amount of tax revenue. In fact, Colorado, in only 3 months of legalization, has raised over $12 million in taxes as of March. That money, pre-regulation would have gone straight into the hands of drug lords and would have likely been used to fund their trade in hard narcotics. And this is only one state, a microcosm of the imminent potential. There are a slew of new cannabis related businesses that have gone public and whose stocks are being traded as the infamous “marijuana stocks”, just another stimulant for the local economy.

3. Hemp. Enough said. Well, not really but it should be – let me fill you in on the amazing by-product that we get from the cannabis plant. Not only does hemp give us the strongest natural fiber known to man, but it also gives us building material, plastic, paper, you can even eat the stuff!

George Washington grew marijuana, he was intrigued by it’s medicinal potential as recorded in his diary, but the even bigger appeal for him was hemp. He even made it mandatory for farmers to grow the plant at one stage. And it turns out that he was onto something: hemp stalks are now being developed into bio-fuel. This in itself could go a long way in reducing carbon emissions.

4. The medicinal benefits of marijuana. The plant has actually been used ever since its potential was realized around 2900 BC by Chinese Emperor Fu Hsi. He said that the plant contained both Yin and Yang. 200 years later Shen Nung, said to be the Father of Chinese medicine, noted the healing benefits of marijuana. It has since been used the world over to treat a wide array of ailments.

It wasn’t really until the 20th century that all of a sudden marijuana became the evil plant that lead to insanity and certain death, a la ‘Reefer Madness’ (cringe). Regardless once again, its potential is being recognized and, with the advances in science that we now have at our disposal, there is more potential for medical marijuana than ever.

These points are only a few of the many in favor of the legalization of marijuana. There are always two sides to every story though, and I encourage you to do some critical research into the topic yourself to form your own opinions. This past weekend, New York became the 23rd state in the US to legalize medical marijuana. Though Governor Andrew Cuomo signed the bill Saturday, it will be at least another 18 months before medical marijuana becomes available in New York for patients, something parents of children in need of the treatment fear.

Missy Miller is an Atlantic Beach resident and mother of two children, Oliver and Katy. Her 14-year-old son, Oliver, suffered a stroke in utero and as a result has a brain stem injury that causes him to have hundreds of seizures a day. Because certain strains of marijuana have received international attention for curbing seizures in children, Missy has devotedto the cause of fighting for the legalization of medical marijuana in New York.

Elite Daily met with Missy earlier this year to discuss her frustrations with the current New York political system, and her fear of losing her son. We’ve continued our discussions with her throughout her fight, all the way up to the big decision in Albany on June 19, and the official signing ceremony in New York City earlier this afternoon.

Re: Why Marijuana Should Be Legalized

The debate to legalize marijuana has gone on for some time. Today I will add my two cents to the debate.

There are several reasons to consider the legalization of marijuana. People will argue that it’s better for you than tobacco, and cigarettes are legal. It has legitimate health uses for certain people. If it were legal it would reduce drug related crime such as drug deals going wrong.

My two cents to add to those arguments is taxes. It’s a huge business, if it were legal it could be taxed. Also it could be taxed heavily. It would probably take a big chunk out of the deficit.

With those benefits, why should it not be legalized? There are several reasons it should remain illegal. It’s still a drug and effects health and judgment. Marijuana is a gateway drug and leads to other harder drugs and criminal activity. Remaining illegal will help prevent the harder drugs from being used as well.

My two cents on remain illegal is the fact that it does kill brain cells. The United States is starting to lag behind in education. Generally other countries are becoming more intelligent. In this day and age it’s all about information and technology. We need the country to be as intelligent as possible. Stopping marijuana use will help.

In conclusion, I am in favor of marijuana continuing to be illegal despite the possible tax revenue that could be generated.

Why Marijuana Should Be Legalized: An Expert’s Perspective

Legal Marijuana is a topic being discussed throughout the world and will actually be voted on by the UN in 2009. The rationalization is that regulation will allow control of the strength of the THC and the decimalization will have a positive social impact. Ten out of fifty states in the US have passed Medical Marijuana Laws and more states will be voting on similar laws in the coming months. These laws are only symbolic at this point because the federal government still has laws forbidding the use, possession and cultivation of Marijuana in the US. If the federal law changes these states are ready, at lest as far as the law is concerned to start distributing marijuana.

Legal Marijuana will impact Addiction Treatment in a number of ways. There will be experts that will insist that people cannot become addicted to Marijuana and that Drug Abuse will be a more appropriate label. Physical addiction to Marijuana will be denied and therefore third party payment for detox will be out of the question. Legalized Marijuana will increase the depth of denial in an addict with the argument that if it is legal it must not be a problem. The use of Marijuana impairs attention and judgment and will make the casual user more willing to try other drugs or partake in questionable behavior.

Marijuana use increases the risk of cancers in repertory system, is linked to leukemia in offspring and is the cause in a decline of cognitive skills especially with adolescents. Social impact and the rise in health costs associated with legalizing Marijuana seems to have been left out of the equation when deciding the benefits of a change in the legal status of this particular plant.

Marijuana is a gateway drug and will lead to using other drugs some of which are more addicting and physically debilitating. Society and the media for years has warned of the dangers of Pot and are now considering making it legal. What massage does that send to those that are just starting to experiment with intoxicating substances? Drug Rehab Centers should get ready for an influx of new patients.

Marijuana Is Now Legal In Colorado

State and local governments in the U.S. began regulating the sale of marijuana in the late 1800s. Many of the states restricted the drug further in 1906 by labeling it as a poison. Most states prohibited marijuana altogether in the 1920s, around the same time as a federal prohibition on alcohol was written into the constitution. Prohibition was repealed in the 1930s; marijuana has continued to be prohibited throughout the United States ever since.

Some states are now passing laws to allow the use of marijuana for medical reasons, however, for which proponents say the drug has many powerful benefits. There are merits and drawbacks to consider on either side of the argument.

The Argument for the Legalization of Marijuana

Proponents of marijuana legalization often stick to the fight for medical marijuana, rather than fighting for blanket legalization for all users. Others say it should be controlled and taxed like cigarettes and alcohol, so anyone over a certain age would be able to purchase it legally. Here are a few of the arguments for marijuana legalization:

• Criminalization limits personal freedom

• Drug dealers lose business with legalization

• Fewer young adults turned into criminals

• Free up courts and police resources for “more important” issues

• Industrial uses for Cannabis, such as clothing

• Arguably less harmful than alcohol, cigarettes and other drugs (in moderation)

• Medicinal benefits, particularly for AIDS and cancer patients

• Reduction in violent crime related to drug disputes

• Tax revenues on sale of marijuana

The Argument Against the Legalization of Marijuana

The opponents of marijuana legalization also have numerous arguments to defend their stance, including the following:

• Marijuana arrests remove criminals from the streets who would be likely to commit more serious crimes in the future

• It’s slippery slope; harder drugs such as cocaine and narcotics may be legalized once marijuana is legal

• Marijuana can act as a stepping stone to harder drugs, such as crack and heroin

• More young children would have access to marijuana if it was sold in stores

• More people would do long-term damage to their bodies from overuse of the drug if it were legalized

• People driving under the influence can cause accidents, similar to drunk driving

• Secondhand smoke would increase

• There are moral oppositions to using marijuana

There’s no denying marijuana has harmful side effects, which is why it was criminalized in the first place. The question remains: Is that enough to make it illegal?

The golden state Cannabis Dispensary Video clip: Trip Harborside Health Center with founder Steve DeAngelo

States with legal medical weed such as Colorado as well as California have regulations that attempt to manage the circulation of medical cannabis. The regulations try to keep any individual which does not have a medical professional’s recommendation from unlawfully obtaining the medicine from dispensaries or care providers. Do these regulations have any type of result whatsoever on the amount of prohibited weed is utilized in the U.S.? Will there be much less of a need for medication testing by employers? The Center for Illness Command yet Prevention reported in 2009 on cannabis use in 2007. Around six percent of those 12 years old yet older stated using cannabis in the past month. Cannabis usage is probably actually much above this, and it is greater in some states where clinical cannabis is lawful compared to where it is illegal. The truth is that cannabis use by employees or the public at huge will probably not change in any way, regardless of the number of regulations are passed.Laws may have

been passed with the intent of decreasing prohibited cannabis usage in states where medical use is lawful, however this is difficult otherwise impossible to do. Sure, dispensaries might accidentally provide the medicine if employees steal it and also give or sell it to others, yet dispensaries are far from the only source of weed. There are a lot of unlawful sources anywhere. In fact, a state that passes brand-new legislations that put tough limitations on weed dispensaries could in fact not directly motivate the black market producers to thrive. This can occur if dispensaries are needed to shut down since they do not comply with state growing standards. In addition, physicians who are quick to distribute clinical cannabis suggestions will certainly be in need even more if customers could not acquire it from illegal sources at dispensaries. They could need to plan a consultation yet undertake an examination and consultation, but this is extremely not likely to avoid anyone who can get free power on weed from a minimum of attempting to come to be a reputable customer. Just stroll into the dispensary with your doctor’s note, and also you have your month-to-month supply. Time is saved by not having to search for an illegal source, yet there is little worry when you have a medical reason. Some marijuana individuals will remain to get their stockpile from treatment takers who grow the pot and also share some additionals with them, as well as the underground sources of marijuana will certainly still exist, as sturdy as ever before. No legislations affect them because they are unlawful in the first place. Factors will certainly take place pretty much as usual.Employers with drug-free plans will certainly need to continue screening as usual. Parents will likewise have to continue to be persistent regarding examining their adolescents.

The inquiry is whether reducing lawful marijuana dispensaries for medical marijuana will certainly impact those that use it unlawfully. Numerous opponents of medical cannabis regulations claim that individuals will merely purchase from pusher that were around just before the dispensaries opened. It is quite uncertain that any individual that is an everyday cannabis smoker will quit making use of cannabis also if they need to drive a distance to get it from one more location. Medication screening will certainly be as vital as ever before if companies intend to maintain a medication totally free workplace. For Details on Urine testing for weed and a strong Medicine Plan for your business, opt in at http://ift.tt/1AsoqkR. Learn if marijuana is legal in Amsterdam or anywhere else outside the United States in this Howcast video.

Internationally, marijuana was first mentioned in a treaty called the 1961 Control Single Convention Treaty on Narcotic Drugs. When that was signed in New York City, really, it was pushed by the United States in a number of, as the lead and they tried to make it so that all countries in the world would gain a monopoly on marijuana and coca and opium, other plants that they wanted to control. Essentially, these countries, world governments, representatives, gave themselves monopoly ownership of legitimate distribution of marijuana.

Over the years, countries have interpreted this treaty broadly, or loosely, depending on what their culture is, what their constitution is, what their customs are. So, for example, most famously, in the country of the Netherlands, with millions of people who’ve lived there for thirty years, they’ve lived in a framework where marijuana is tolerated to be sold in cafes called coffee shops and tolerated to be grown at home. And they have a system of purchasing based on age restriction. You know, they still consider themselves to be in compliance with this treaty because they’re saying they haven’t legalized it, but they’re just choosing not to enforce that law.

So, the treaties are really kind of a historical relic and a lot of countries even including Uruguay, Spain, Portugal, are moving in very different directions from this sphere of those treaties, which was all about top-down control. A lot of countries are taking a lot more liberties with the control or regulation of marijuana compared to, but there are other countries where the situation is very different and marijuana can be the grounds to put you to death. For example, in Singapore and Malaysia, Qatar, Saudi Arabia, even India and Pakistan all have death penalties on their books for the use of marijuana.

I think recently, the Supreme Court struck theirs down, but this shows you the extreme to which some of these countries took the liberties in this treaty and they have executed people, versus other countries that treated it as a culturally accepted behavior.

In the United States, it’s a huge patchwork that varies from state to state, but our federal government continues to maintain a zero tolerance hard liner approach, which really isn’t consistent with the, the will of the majority of the people in the country.

How To Open A Medical Marijuana Dispensary

In November 2010, the people of Arizona passed Prop 203, legalizing Medical Marijuana. This was the 3rd time marijuana’s medicinal usage has actually passed in AZ. It is appearing as if the third time is the charm, however, as the Arizona Department of Health Services is placing Rules and Regulations into place at the end of March 2011 for Dispensaries and Patient ID cards.

What are the rules for Arizona Medical Marijuana Dispensaries? Applications for obtaining a medical marijuana dispensary are being accepted starting in May 2011. The AZ Department of Health Services plans to allocate these dispensary certificates based on an analysis of Community Health Analysis Areas.

These Community Health Analysis Areas were created in 2005 to align with growing rural and urban areas. In highly urban areas, a CHAA contains 100,000 people. In a rural CHAA the population is about 10,000 people. Each county in Arizona will have at least one dispensary. If only one complete application is received for a dispensary for any particular CHAA, then it’s approved. If any CHAA has multiple completed applications, a random selection process will occur.

To open a dispensary, the applicants must pass a background check, be over 21, and have been Arizona residents for the past three years. Each dispensary must employ or contract with a medical director. The medical director cannot provide written certifications for marijuana and must provide training to the staff along with providing educational materials/information to qualifying patients and caregivers.

For the whole state of Arizona, 124 licenses will be given out. It appears there may be close to 5,000 applications for those licenses. At least one will be given out for each Arizona county. The state would like to track the inventory from seed to cultivation to dispensary to patient. That will hopefully minimize marijuana from being siphoned into the world of drug dealers.

Each Arizona dispensary will be required to cultivate and grow their own marijuana. Initially the Rules stated 100%, but the latest states 70% so dispensaries will be able to purchase 30% from approved growers, patients, caregivers, or other dispensaries. The 70% being grown must be on-site in an enclosed area and there will be specific provisions regarding the security in place at the dispensary.

Dispensaries must be non-profit entities. This means profits cannot be distributed to the owners, simply the salaries that are set. At this point, it appears Arizona will be specifically limiting the salaries that can be received.

Qualifying patients with an Arizona Medical Marijuana Registry ID card may purchase up to 2.5 ounces of marijuana every two weeks from a certified, licensed dispensary. If there is no dispensary open within 25 miles of the patient, that patient can grow his or her own marijuana. Patients will not be allowed to consume marijuana at the dispensary. Arizona Dispensaries will be able to sell edible food products infused with marijuana as long as the dispensaries comply with specific preparation regulations and they are labeled to show the specific marijuana content.

There will be set costs for the initial registration of a dispensary ($5000), renewals ($1000), and a cost for changing the location of a dispensary ($2500). The objective of the Arizona Dept of Health Services is for dispensaries to provide information as well as marijuana. Educational materials will need to be provided for patients about drug interactions, safe usage, and information about substance abuse programs.

David L. Greene, MD is CEO of Arizona Medical Marijuana Certifications, which assists patients with debilitating medical conditions to obtain an Arizona Marijuana ID Card. The number Toll Free is (855) AZ-IDCARD

Marijuana Legalization Debate (Part 1) — The Doctors

Medical Marijuana is a controversial subject across the United States. There are federal laws about marijuana. The federal government has ruled all marijuana illegal, and does not recognize any medical uses of it. However, there have been many studies done on the subject, and it appears that using marijuana can help people who have certain diseases in certain circumstances.

Currently 14 states and the District of Columbia allow Medical Marijuana. Since possession of marijuana for medical purposes is still possession of marijuana according to the federal laws, the states have to be very careful about it. Most states that medical marijuana laws very strictly regulate who can and who cannot have it and how they can get it. In all states the person needs to have a prescription form a doctor for it. They also need to have a confirmed diagnosis of one of the recognized ailments which might be helped by medicinal use of marijuana.

Once a person has a prescription for Medical Marijuana they can’t just go out and buy it on the street, or in most cases grow their own. In most of the states the law is that the medicinal marijuana has to be gotten from a dispensary. This is like a pharmacy. The dispensary is in charge of growing and distributing the product. Dispensaries are very strictly regulated. To run a dispensary a person will need to have a criminal background run, and they may not have any drug charges in their history. Each state has further regulations about the use of marijuana for medical use in the workplace.

Each patient needs to be knowledgeable about the regulations in their state. They also need to make sure that they have documentation about their use of marijuana for medical purposes with them at all times.

Essentially new economic growth is appearing in these states with the new regulations. Lawyers, Doctors, supply houses and education centers like dispensary are benefiting and contributing to a new market that was once suppressed underground by legislation. Many people are still weary of the changes due to the fact that the legislation only protect them as far as state law will stand in court.

In the 14 states where Medical Marijuana is legal the users are still at risk of arrest by the DEA since it is still against federal law. In those 14 states each year bills are taken up to further regulate marijuana for medical use or to make it illegal again. The battle to decriminalize or legalize marijuana rages on in the other 36 states and at the federal level.

A referral (accreditation) consists of a doctor’s created statement that weed would certainly be medically advantageous for the patient’s incapacitating condition. It is not a marijuana prescribed, as a prescribed is legally specified as a created order to an accredited pharmacologist to provide the drug. Cannabis prescriptions are difficult because of prescription medicines undergoing considerable government regulation. This was the problem with Arizona’s preliminary 1996 authorization, Prop 200. It was worded so as to call for people looking for weed to get two”prescribeds”. As a result of that, the law was efficiently dead.Physicians which suggest marijuana medicinally are secured from government prosecution so long as they don’t obtain included with distribution or manufacturing. Hundreds of doctors are recommending cannabis under state medical weed regulations, therefore much, no person has actually been punished by the federal government government.Patients could seek a qualification from their general practitioner, however, he or she might not want to supply the referral. This can be based on anxiety of prosecution, or merely not understanding enough concerning it. If that happens, clients are legally within their right to get a duplicate of their medical records and also seek an additional doctor which is knowledgeable concerning clinical marijuana.States generally call for referrals come from a medical professional accredited to practice because state. Weed Revolution: Marijuana on the ballot across the country

“Let’s Legalize Regulate And Tax Marijuana!’ Congressman Blumenauer

During the crisis just over our borders with the Drug Wars in Mexico, we have been watching an escalation of crime creeping over the borders here. Many that favor legalizing Marijuana believe that we ought to legalize pot, regulate it, and tax it. They say this would indeed weaken the drug cartels and gangs by taking away a major cash product for them.

That’s ridiculous, as the Drug Cartels, have all sorts of other more dangerous drugs to make money with and they are ruthless, they are everywhere and they know exactly what they are doing. In fact, if you are a border town police chief and not on the Drug Cartels payroll, your life expectancy is something like three-days now.

Still many in the US who want to see drugs legalized will tell you; “Our government’s solution is to declare war on drugs and it just does not seem like it is working.”

They realize of course that there are those who like the way things are, control huge amounts of money flows, and love the fact that the government removes their competition in the illegal drug trade? As far as Marijuana, I don’t smoke it, and really don’t care one way or the other, but the THC in high quality pot is quite bad for the human body.

If we allow pot to be legalized, there are a whole slew of other social, legal and health issues that go along with it. As far as legalizing marijuana to stop the drug wars in Mexico, well, that really is not the world’s best argument, although I am not surprised the promoters of legalized pot are using it. Think on this.

How to open a medical marijuana dispensary in California?

Many people across the Country use cannabis for medicinal purposes. Luckily for those in the state of Colorado they can now legally seek relief without fear of the law. In the November 2000 general election, the people of Colorado voted to legalize the use of medical marijuana for persons suffering from debilitating medical conditions. Amendment 20 allows a patient to have up to 2 ounces of cannabis in their possession and grow up to 6 plants.

What does this mean for you? Well, if you have one of the qualifying medical conditions then just follow this simple guide to legally apply for your medical cannabis card.

First you will need to schedule a medical marijuana evaluation with a state approved doctor. There are many resources for researching and choosing a compassionate doctor across Colorado, so be sure to do the proper research to find a reputable source. It’s best to provide this doctor with your medical records if possible. While this makes the process easier for everyone, it’s not required at many locations.

Your doctor will need to diagnose you with one of the following conditions to be eligible for the official Colorado Medical Marijuana Registry:

Once your doctor approves the recommendation, they will need to fill out the Physician Certification form. Only licensed medical doctor’s in good standing with the state of Colorado may sign this form. Next is your official Registry Application Form. This needs to be signed, dated and notarized in front of an official state Notary. Then you need to include a photo copy of a valid Colorado ID (driver’s license, state ID, etc). Finally, a $90 non-refundable application fee must be paid by an included check or money order payable to CDPHE.

All forms are available for download from the official Colorado Department of Public Health website. Be sure to make photo copies of everything! Then package and mail all the materials to the Registry’s Office within 60 days of the doctor’s signature:

Colorado Department of Public Health and Environment Medical Marijuana Registry or MMR HSVRD-MMP-A1 4300 Cherry Creek Drive South Denver, CO 80246-1530

That’s really all there is to it! Next you will have to play the waiting game because the Registry’s Office is currently way behind on approving new applicants. Estimated wait times can be up to 6 months from when the Registry Office receives your application. The good news is you can use photo copies of all your documents as your temporary proof of registration until you receive your card in the mail.

Cannabis is still a drug but it is extremely helpful in treating many people with various aliments. I strongly recommend reading the official Rules and Regulations for Medicinal use of Marijuana from the Colorado Department of Health before making any decisions regarding the medicinal use of cannabis. In the end the best decisions are informed decisions, so be sure to do thorough research on any topic involving your health before acting.

How you can make feminized marijuana seeds

This short article narrates the implementation of the Michigan Medical Weed Act, passed via referendum in the 2008 basic election. As anticipated, when applied to our human tapestry, the MMA has undergone some already-classic judicial interpretations, with a solid assurance of more to come. The Michigan Law-makers passed the MMA on December 4, 2008, making Michigan the 13th state to enable the farming as well as belongings of cannabis for clinical functions. The Act cited a collection of searchings for connected to the helpful uses of weed in dealing with nausea, pain and various other impacts from a selection of debilitating clinical disorders. The Act additionally notes that according to the FBI, 99 % of all cannabis possession apprehensions across the country are done according to state, as opposed to government law. It is important to note that ownership of the medicine remains unlawful under government law.The Mixed Martial Arts specifies a”debilitating clinical disorder”as cancer, glaucoma, HIV, hepatitis C, and also other conditions together with various other persistent afflictions which induce discomfort as well as nausea. A”key caregiver”is specified as,” an individual which goes to the very least 21 years old and also who has agreed to help with a patient’s clinical usage of weed and also who has actually never been convicted of a felony entailing controlled substances.”A” qualifying patient”is “a person which has been detected by a physician as having a debilitating medical disorder.” The fundamental mechanics of the Act give that qualifying clients and also medical care suppliers(cannabis growers

)need to possess a”registry recognition card “, issued by the Department of Neighborhood Wellness. Tens of thousands of applications have been processed; numerous thousands stay pending with more submitted weekly; the demand for accreditation, for weed, is relatively insatiable below in Michigan. The high demand is easy to understand. Cardholders are not subject to jail or prosecution for cannabis possession/distribution gave the client keeps much less compared to 2.5 ounces of

smokeable pot. Treatment companies are allowed to keep approximately 12 plants for each and every qualified individual; stems, seeds and pointless roots do not count towards the plant limitation.Physicians additionally have resistance from prosecution relative to their certification of the patient’s demand for the medication, so long as they conduct an analysis of the individual’s case history. A legitimate physician-patient partnership is required.Since the U.S. Supreme Court decided the case of Conant vs Walters in 2003, medical professionals have actually had the ability to suggest an individual’s usage of marijuana (yet can not prescribe pot by positioning the referral on a prescription type ). Physicians can likewise make notes concerning their recommendations in the client’s graph and also can indicate in support of a patient’s clinical use of cannabis in a court of law. The Supreme Court’s Conant decision paved the way for flow of the MMA.Primary treatment suppliers could obtain settlement for their cannabis. Marketing weed paraphernalia likewise is enabled under the MMA, and such stuff can not be seized.Persons just existing throughout the use of weed for medical functions similarly are exempt to arrest.Sound also great to be real? When marijuana is dispersed to individuals aside from qualifying people, the registration card is revoked, and the service provider is subject to a 2-year felony. Likewise, driving while under the influence of weed stays prohibited, as does smoking in public. Use or property of pot on college properties or on college buses remains prohibited. As well as indeed, it stays illegal to smoke in a jail or a penitentiary, no matter your clinical condition. The Act set a short timetable(120-days)for the Department of Neighborhood Health and wellness to promulgate laws for the administration of the possession/distribution credential. The delay in the promulgation of these regulations gave way to confusion amongst law enforcement, the general public as well as some judges as to just what is lawful and also just what is illegal. For instance, the 2009 Redden case from Madison Heights

entailed a couple arrested throughout a drug-raid. The couple had secured certification cards before their arrest and received the cards a month after their arrest. In rejecting the case brought against both defendants, 43rd Area Court Robert Turner characterized the Mixed Martial Arts as, “the worst piece of legislation I have actually viewed in my life “, baseding on the Detroit Information. Judge Turner’s termination was appealed by the Oakland County Prosecutor where it was affirmed in the Oakland County Circuit Court.Earlier this year, the Michigan Court of Appeals affirmed Oakland Circuit Court Judge Martha Anderson’s reinstatement of the criminal fees against Redden and also Clark. Now, the accused Madison Levels couple will certainly either have to beg or go to trial. At the time of the raid on the couple’s house, the Oakland Region Constable took possession of 1.5 ounces of pot, some small cash money, and also about 21 tiny plants. Three weeks before the raid, each offender had actually sented in to a clinical certification exam with Dr. Eric Eisenbud( not making it up)of Colorado(and of the just recently established Hemp and also Marijuana Structure Medical Facility)and obtained a medical weed card according to the Mixed Martial Arts. Their cards, nonetheless, had not been issued at the time of the raid.At the couple’s initial examination before Court Turner, the prosecutor argued that: a) the defendants were required to avoid “treating “with weed while their applications to the State of Michigan’s Division of Area Health and wellness were pending; and b) the defendants did not have an authentic physician-patient partnership with Dr. Eisenbud.Judge Turner suggested that the MMA was confusing relative to exactly what comprised a sensible amount of cannabis. The defendants in this case were located with an ounce and a

one-half; the MMA enables 2.5 ounces.Judge Turner made the adhering to ruling: Because of that, I think that area 8 entitles the offenders to a dismissal, even though they did not have the valid medical card, considering that part 8 claims if they can show the fact that a medical professional believed that they were likely to receive a healing advantage, and this doctor bore witness that. And also Dr. Eisenbud is a medical professional accredited by the State of Michigan. Which’s the only need that the statute has. You don’t need to be any kind of sort of doctor, you merely have to be a licensed doctor by the State of Michgan. So, based upon that, I find section 8 does apply. And also I believe I’m bound to dismiss this concern based upon area 8 of the statute.Under the suitable court rules, the district attorney appealed the area court termination to the Oakland Circuit Court. In reversing her area court counter-part, Judge Anderson held that Court Turner incorrectly acted as a finder of reality in dismissing the instance. Judge Anderson likewise wondered about whether the couple can obtain themselves of the MMA’s affirmative defenses in any way, due to their supposed failures to adhere to the arrangements of the act; i.e. keeping the pot segregated and also locked-up, and waiting till they obtained their cards from the Department of Neighborhood Wellness before expanding their pot.At the time of the Madison Levels bust, nonetheless, the couple could not have actually obtained weed cards because the DCH had not begun releasing the cards. To date, nearly 30,000 qualifications have been issued. In their September 2010 point of view verifying Judge Martha Anderson, the Court of Appeals held that the MMA’s positive defenses were readily available to accuseds despite the fact that they did not have their cards at the time their pot was taken. The Court of Appeals held against defendants, nevertheless, on the basis that, at the time of their initial exam in area court, their affirmative protection under the MMA was incomplete as well as thus created truth questions. The Court found the adhering to fact issues to be unsolved at the verdict of the test: the legitimate of the physician-patient partnership; whether the amount of cannabis located in the residence was”sensible” under the Act; and whether the marijuana was being used by accuseds for palliative purposes, as called for by the Act.The most fascinating aspect of the Court of Appeals ‘Redden choice is the pungent agreeing point of view of Judge Peter D. O’Connell. Court O’Connell wrote separately because he would have more narrowly tailored the positive defenses available in the MMA, as well as due to the fact that he desired to”clarify”on some of the general conversation of the Act set forth in the briefs and at dental argument.Elaborate he did. Court O’Connell’s 30-page viewpoint very first notes that the belongings, distribution and manufacture of marijuana remains a federal crime and also further notes that Congress has actually exclusively located the plant to have” no appropriate medical uses.”In exactly what will certainly end up being a traditional line from his point of view, Judge O’Connell creates,”

I will certainly attempt to cut through the haze surrounding this regulation.”The judge is skeptical that individuals are really utilizing pot to”medicate”and presumes that they are using the plant for recreational purposes. He additionally remembers of the crappy of the regulation to the level that it conflicts with various other regulations stated in the Wellness Code.Judge O’Connell next takes a tour de force via the legal past history of the Mixed Martial Arts. Below, we find out that the

act was based on model regulation suggested by lobbyists referred to as the Cannabis Plan Job of Washington D.C. The team advancements both the medicinal and recreational usages of weed.”Complication”, and also lots of it, is exactly how Judge O’Connell checks out the Mixed Martial Arts. In among the several footnotes to his point of view, the Judge cautions against all marijuana use till the rating is cleared up, once and for all, by the Michigan Supreme Court: Till our Supreme Court provides a last detailed analysis of this act, it would certainly be prudent for the people of this state to avoid all use of weed if they do

not desire to run the risk of breaking state regulation. I once again release a demanding warning to all: please do not attempt to interpret this act upon your very own.

Reviewing this act is similar to taking part in the Triwizard Tournament explained in Harry Potter and also the Cup of Fire: the labyrinth that is this statute is so complicated that the final result will only be understood once the Supreme Court has had an opportunity to assess and also get rid of the haze from this act.Euan Abercrombie, 1st year pupil at the Hogwarts school would most likely remark;”Wow “. For their part, the criminal protection bar, commenting using listserv, have actually basically gone wild over the concurring opinion, with its a number of internet site referrals and photos of

weed promotions. The consensus amongst the defense bar, nevertheless, is that the majority opinion is right and that Court Anderson, at the end of the day, obtained it straight; Redden was not the cleanest case to dismiss under the Act.The Oakland County Constable and Prosecutor appropriately anticipated the Court of Appeals’September decision. A couple of weeks prior to the Redden decision, they conducted a series of dispensary raids, ruffling tons of feathers along the way.Of training course, an application for leave to allure has actually been submitted with the Michigan Supreme Court. For added procedural advice, we have readied a legal guide for the Mixed Martial Arts for those looking for to utilize weed for legit palliative objectives under the Act. Remember, nevertheless, that at least one appellate jurist would have folks managing chronic “pain”with prescription medications until the medical weed mess is figured out by our Supreme Court.Redden is not the only instance causing some MMA consternation. Rodney Koon’s instance has actually received notoriety. Koon was convicted of a misdemeanor since he admitted to cops that he made use of weed to “medicate”previously in the day that he was pulled-over by the cops. Koon additionally confessed to consuming a draft beer, yet his blood liquor was within lawful limits. Without sufficient funds to appeal, Koon is stuck with his conviction, despite the fact that he had a pot card at the time of his arrest.Ordinances have sprung-up across the state to truncate the scope of the Mixed Martial Arts. Bloomfield Hills, for instance, passed a statute in October calling for card-carrying qualified

clinical weed customers to register with the Bloomfield Township Authorities Department. The statute additionally calls for the entry of a develop to the authorities divulging the “person’s “motorists license number and also day of birth, whether the patient has or leases their home, as well as recognizing how many other clients discuss their home.In addition, the ordinance limits the variety of medical weed patients that can live at one address and prohibits growing medical weed throughout Bloomfield Town. Infraction of the regulation is a 93-day misdemeanor carrying a$500 fine.Bloomfield Hills is amongst several towns that have passed regulations that limit the arrangements of the Medical Cannabis Act, outlaw conduct licensed by the Act, or both. Now the statute is the topic of a claim filed versus the town by 2 smart [their” customers”are John and Jane Doe]

proficient criminal defense lawyer: Tom Loeb and Neil Rockind. The claim, certainly visiting the Michigan Supreme Court, does not seek cash damages however rather, declarative as well as injunctive relief.Township by township, the Mixed Martial Arts is coming under fire for a glaring flaw: it is a maneuver for leisure pot individuals. Yes, there are reputable medical cannabis individuals available, in spades, for which the MMA was designed to assist. There are additionally several”people” whose clinical documents were assessed with a passing glance by a medical professional a lot more thinking about the high-volume assessment costs compared to in determining whether the individual has an authentic chronic medical problem of the type called for by the Mixed Martial Arts. The LawBlogger asks yourself how many accredited users, amongst the 10s of countless backlogged candidates, are under the age of 25; or are college youngsters whose only persistent condition is their need to event down.As these legal challenges grind with the court system over the following two or three years, the Mixed Martial Arts will be subject to death-by-ordinance on a township-by-township basis. Attorneys Rockind and Loeb said in their interview announcing their claim that the regulation in Bloomfield Hillsides could not stand to the extent it contradicts a valid Michigan law. While it could not be the very best example of firmly composed legislation; while it certainly suffers from issues of perception/deception, the MMA is a valid state

regulation. The appellate courts will certainly have no choice yet to void ordinances that restrict the scope of the Act, or criminalize it’s legitimate purposes. This past autumn, the current election was a set-back for progressive cannabis legislations. California’s Proposition 19 shed by a vote of 56 % to 44 %. If successful, the suggested legislation would certainly have been the initial in the nation to legislate the recreational usage of marijuana. In Arizona, the medical marijuana proposition lost.In America, the pot campaign lost due to the fact that also couple of citizens under age 26 ended up as well as mild citizens denied the campaign. Recent physical violence with Mexican medication gangs in both California as well as Arizona did not help either initiative.Mixed messages drift around the problem right here in Michigan.

Recently, a big pot-expo arranged for the Pontiac Silverdome, billed as the biggest pot-party on the planet, was terminated at the last minute. All this raises the inquiries: do we actually need to legislate pot? Is ours a pot-smoking nation? Does weed have genuine palliative properties? One of the significant issues of perception with clinical marijuana regulations is that people are simply experiencing the management steps to obtain “clinically “certified to utilize pot, but are smoking on a leisure basis. No great comes of a legislation that establishes demands that are regarded as a farce. It would certainly probably be much better to legislate weed outright, then regulate its manufacturing, sale, and distribution.California was really looking forward to billions in pot-derived state income

. Below in Michigan, there is confusion concerning that can legitimately expand pot and just how it ought to be grown and distributed to “individuals”. In Arizona, the inquiry is also close to call 3-days after the mid-term elections. So after that, exactly what are they cigarette smoking? That’s just what Detroit-based Cannabis Counsel legal representative Matthew Abel is asking of the Michigan Senate Judiciary Committee, who complied with

previously this year, in January, in order to talk about a package of costs which would certainly modify the public wellness code to ensure that medical cannabis have to be given by pharmacists, and to identify medical weed as a timetable 2 controlled element.

“It appears that if the law-makers ever passed these expenses, they would certainly be in dispute with the medical marijuana law,” Abel said.”So they would certainly require a 3/4 vote to replace the legislation, and you know that they can’t also obtain 3/4 of the law-makers to settle on lunch, not to mention this.”Southfield-based lawyer Michael Komorn, who also works as the treasurer for the Michigan Medical Weed Association, said the costs are similar to expenses introduced last year; in 2012, the costs which also would have allowed for 10 marijuana expanding facilities to be connected with a drug store, obtained no traction. This year’s manifestation of the bills would essentially make all production of medical marijuana unlawful, though usage would still be secured by law, Komorn claimed.”It’s like the stamp act, mysterious and without any understanding of just what truly is happening with individual requirements, “Komorn stated.”Base line, this is an effort to reverse the Michigan clinical marijuana act.”It’s difficult, Abel claimed, to require dispensing of medical weed through drug stores.” They don’t have a supply, and also no chance to obtain it.

There’s just no chance for them to do it,”Abel said.Still, he’s resting simple with the concept that the costs are going nowhere, and also are really more about grandstanding for political appeal than they have to do with the Michigan medical marijuana law.Now that the MMA has been around long enough to generate some appealing situations and also disputes, we have to wait until one of them percolates via the Michigan Supreme Court so as to get a true feeling of this legislation. Our blog takes the position that the MMA is flawed and thus, subjected to failure, as long as it can be made use of to mask leisure pot usage. Probably one of the most sound judgment thing to do at this factor is exactly what Peter Tosh required worldwide: merely legislate it.Timothy P. Flynn is a lawyer practicing in Southwest Michigan,
